Terms of Service

1. Agreement
These Terms govern your use of the Daylune app, operated by Nexify Labs Pty Ltd (ACN 699 587 589, ABN 79 699 587 589), an Australian company in Brisbane, Queensland, Australia (“Daylune”, “we”). By creating an account or using the app, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use Daylune.
2. Eligibility
You must be at least 18 years old to use Daylune. By using Daylune you confirm you meet this requirement. Daylune is not intended for, and may not be used by, anyone under 18.
3. Daylune is not medical advice (important)
Daylune is a lifestyle and wellbeing journal — not a medical device, healthcare service, or crisis service. It does not provide medical or mental-health advice, diagnosis, or treatment, and is not a substitute for professional care. Insights and patterns (including AI-generated ones) are informational only.
Daylune is not for emergencies. If you are in crisis, thinking about harming yourself, or need urgent help, contact a qualified professional or your local emergency or crisis service immediately. You use Daylune, and rely on anything in it, at your own discretion.
4. Your account
You’re responsible for your login credentials and for activity under your account. Keep them secure and tell us promptly at [support@yourdomain] of any unauthorised use.
5. Your content
You own the entries and content you create. You grant us a limited, non-exclusive licence to store and process that content solely to operate and provide the app to you — including computing your statistics and, only if you opt in, generating numeric-only AI insights. We don’t claim ownership of your journal, and we don’t use your content for any purpose beyond running Daylune for you (see our Privacy Policy).
6. AI features
Daylune includes optional AI-assisted insights that are off by default and run only after you separately turn them on. When enabled, only numeric/structured data (never your free-text notes) is used to generate observations. AI output:
is generated automatically and may be inaccurate, incomplete, or out of date;
is labelled as AI-generated and is for general information only; and
must not be relied on for medical, psychological, financial, or other important decisions.
You can turn AI insights off at any time in settings.
7. Acceptable use
Don’t misuse the app. In particular, don’t: use it unlawfully; reverse-engineer or attempt to extract source code (except where the law allows); try to access other users’ data or our systems; disrupt or overload the service; scrape or harvest data; or infringe others’ rights.
8. Subscriptions (Daylune Plus)
Daylune offers a free tier and a paid Daylune Plus subscription.
Paid subscriptions are billed through the Apple App Store or Google Play under their terms; we don’t process or see your payment details.
Auto-renewal: subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the current period ends. We will make the price, billing period, and renewal terms clear before you purchase, as required by applicable law (including US automatic-renewal laws and EU/UK consumer law).
Free trials (if offered) automatically convert to a paid subscription unless you cancel before the trial ends.
Manage or cancel anytime in your Apple App Store or Google Play account settings.
Refunds are handled by Apple/Google under their policies and by applicable consumer law, including the Australian Consumer Law and, for New Zealand users, the Consumer Guarantees Act / Fair Trading Act, which provide consumer guarantees that cannot be excluded.
Price and plan changes apply only to future periods, never to a period you’ve already paid for, and we’ll give notice as required.
9. Availability and changes to the app
We may update, add, suspend, or discontinue features. We aim for reliable service but don’t guarantee it will be uninterrupted, secure, or error-free, and we’re not responsible for issues caused by your device, network, or the app stores.
10. Disclaimers
To the extent permitted by law, Daylune is provided “as is” and “as available” without warranties of any kind, express or implied. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under mandatory law that cannot lawfully be excluded — including under the Australian Consumer Law and equivalent laws such as New Zealand’s Consumer Guarantees Act.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, loss of data, or for decisions you make based on the app (including AI-generated insights). Where our liability can be limited but not excluded, it is limited to the greater of (a) the amount you paid us for Daylune Plus in the 12 months before the claim, or (b) AUD $100. Nothing in these Terms limits liability that cannot lawfully be limited, including under the Australian Consumer Law.
12. Termination
You may stop using Daylune and delete your account at any time (More → Delete account). We may suspend or terminate your access if you materially or repeatedly breach these Terms, or where required by law. Sections that by their nature should survive termination (including 5, 10, 11, 13, and 14) survive.
13. Changes to these Terms
We may update these Terms from time to time. We’ll post the updated version and change the effective date, and for material changes we’ll give reasonable notice (for example, in-app). If you keep using Daylune after changes take effect, you accept the updated Terms; if you don’t agree, stop using Daylune and delete your account.
14. General
Governing law: these Terms are governed by the laws of Queensland, Australia, and you submit to the courts of Queensland, without affecting any mandatory consumer protections you have in your country or state of residence.
Severability: if any provision is unenforceable, the rest stay in force.
No waiver: if we don’t enforce a term, that isn’t a waiver of it.
Assignment: you may not transfer these Terms; we may transfer them to a successor (e.g. on a sale of the business), and your statutory rights are unaffected.
Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about Daylune.
